This is my letter to Barry T. Ward dated September 5, 2008. This letter was a request for a refund of all fees paid to Barry T. Ward. It further Makes Barry T. Ward aware of this website and states the purpose of the website. Barry T. Ward was cautioned in this letter that bad faith behavior would be made public. Therefore his response to this letter is posted after this letter.

Well as you can see Barry T. Ward is concerned about this Website. He claims he is being blackmailed, which is simply not the case. I am asking for a refund of fees paid to Barry T. Ward and requesting that he not Withdrawal from cases (including substitution of attorney and motions to be relieved as counsel). He makes the standard cease and desist statements and then for good measure throws in the threat of both civil and criminal action. Please note that Barry T. Ward does admit to withdrawing from "practically every case." He claims this is common, but my research does not support this claim and I believe that is a smokescreen in the hope that will stop a full investigation into his case history.

A couple of comments regarding a few statements in Barry T. Wards letter. The balance due that Barry References can be seen on my Bill from Barry's office. The entire bill is in dispute, however most of that remaining balance is a result of Barry T. Ward claiming that they were not reimbursed for court costs. In reality Barry was given a check for $320 in March 2007 and although he cashed it, he is now claiming he never received the check. I have recently put in a request to my bank for a copy of this check and will soon post it to this website. I wonder if Barry's Pulls the ole "We have no record of your check" thing on other clients? I did indeed attempt to have the credit card charges reversed. According to my credit card company, Barry Dissolved his corporation (Barry T. Ward Inc.) days after the charge was made and threatened to sue the credit card company if they attempted to charge back a corporation that no longer existed. I am now investigating why the corporation was dissolved and will report back to this website what I discover.

Barry T. Ward also makes mention of a restraining order in my case. It is true there was a restraining order in my case. There might not have been, but Barry T. Ward refused to represent me on that matter after he was paid $5000 and was demanding another $2500 in addition to the $5000 he was already paid to make a court appearance on that matter. Barry T. Ward Refused to use part of that $5000 retainer towards representing me on that matter. I asked for the return of my retainer to seek another attorney and although no actual work had taken place, I was told the retainer was unrefundable. As a result, I was forced to go to court with no representation and a restraining order was granted for six months. This also seriously damaged my case going forward. However there was no admonishment from the Judge and that is an entirely false statement by Barry T. Ward. I have generally blacked out all references to my case number, but I will be happy to provide the case info to anyone who is interested in obtaining the court transcript to check up on Barry's character in making that statement.

Lastly, how professional is Barry T. Ward to make the statement "discuss the matter like a man, rather than hide behind letters and a website?" I mean, c'mon do you want an attorney that virtually calls you out? I didn't mention this before on this website, but Barry T. Ward in my experience gets really nasty when you confront him on his conduct and billing practices. When I first questioned his billing methods on the phone, he angerly suggested that I get a $600 an hour attorney and used several four letter words throughout the conversation, which I felt was inappropriate to be cursed at while paying him $350 an hour. But that's what I got at the Law Offices of Barry T. Ward "Where Every Client Is Important."
